Family and Medical Leave Act (FMLA)

Purpose
This policy explains how the federal Family and Medical Leave Act, or FMLA, will apply at Memorable Home Buyers. It is forward-looking. The FMLA applies to employers that have at least 50 employees within a 75-mile radius. Memorable Home Buyers is a small Maryland real estate company and is not yet a covered employer, so these provisions will take effect once the company meets the FMLA coverage threshold. We are publishing this now so our standard is clear as we grow.
What the FMLA Provides
Once it applies, the FMLA entitles eligible employees to take up to 12 weeks of unpaid, job-protected leave in a 12-month period for any of the following reasons:
- The birth of a child and to care for the newborn within one year of birth
- The placement of a child for adoption or foster care and to bond with the child within one year
- To care for the employee’s spouse, child, or parent who has a serious health condition
- A serious health condition that makes the employee unable to perform the essential functions of the job
Eligible employees may also take up to 26 weeks of leave in a single 12-month period to care for a covered servicemember with a serious injury or illness when the employee is the servicemember’s spouse, child, parent, or next of kin.
Employee Eligibility
Once the company is a covered employer, an employee is generally eligible if they:
- Have worked for the company for at least 12 months
- Have worked at least 1,250 hours during the 12 months before the leave begins
- Work at a location where the company has at least 50 employees within 75 miles
Job and Benefit Protection
During FMLA leave, group health benefits will be maintained on the same terms as if the employee had continued to work. On return from FMLA leave, an eligible employee is restored to the same job or an equivalent one with the same pay, benefits, and terms of employment.
No Retaliation
Once covered, the company will not interfere with, restrain, or deny the exercise of FMLA rights, and will not retaliate against anyone for requesting or taking FMLA leave.
