Can I Sell My House While It Is in Foreclosure in Maryland?

Yes. In Maryland, you can sell your house at almost any point before the foreclosure auction. The home is still yours until that sale happens and the court ratifies it. Right up to that date, you have the right to sell.

Most people don't know that. The notices start coming, they assume the bank already owns the house, and they stop opening the mail. The auction date is not the day your options end. It's the deadline you're working against.

Where the sale window actually is

Maryland foreclosure moves in steps, and there is more room in it than most homeowners expect.

After you fall behind, your lender sends a Notice of Intent to Foreclose. By law, they cannot file the court case until at least 90 days after the missed payment. Once they file the Order to Docket, you still get another 45 days of notice before a sale can be scheduled.

At every one of those steps, the house is still yours to sell. Selling does not get harder as the auction gets closer. It just gets tighter on time.

What selling before the auction does

When you sell before the sale date, the money from the sale pays off what you owe the lender. The loan gets satisfied, and the foreclosure case closes. There is no auction, because there is nothing left to auction.

If your house is worth more than what you owe, that difference is yours. You keep your equity instead of losing it on the courthouse steps. A completed sale also keeps a foreclosure off your credit report, where it would otherwise sit for seven years.

Selling is one option. It is not the only one.

Before you decide anything, it is worth knowing every path you have.

You may be able to reinstate the loan by paying the past-due amount and fees to bring it current. You may qualify for a loan modification that changes your terms so the payment fits your budget. Both of those keep you in the house. Your loan servicer handles them, and a HUD-approved housing counselor can walk you through them for free.

Selling makes sense when keeping the house is not realistic. When the back payments or the repairs add up to more than the home is worth to you, or when you would rather take your equity and move on. That is the situation we work in.
